Terms And Conditions
These Terms and Conditions determine the conditions of use of the websites, applications, and other offerings from Smart Projects SAL OFFSHORE (collectively, the “ADWIAH Platform”) which the user/member expressly and/or tacitly accepts when consulting them. The terms “ADWIAH”, “we”, “us”, or “our” refer to the Smart Projects SAL OFFSHORE entity duly registered in the special register of commerce in Beirut-Lebanon under the number /1809168/
If the User/Member does not accept these Terms and Conditions, then he/she will not be able to access the “ADWIAH Platform”. If the User/Member is minor under age, he/she undertakes to consult the Website only in the presence of his/her parents or guardians who have previously accepted these Terms and Conditions, and his/her access to the Website shall be deemed as being an express acceptance of his/her parents and/or guardians of these Terms and Conditions.
These Terms and Conditions may be modified by ADWIAH at any time. When material changes are made to these Terms, ADWIAH will post the amended Terms and Conditions on the ADWIAH Platform. ADWIAH will also provide the User/Member of any material changes by email, at least /15/ days before the date they become effective. If the User/Member disagrees with the amended Terms and Conditions, he/she may terminate this agreement immediately as provided in these terms. If the User/Member did not terminate his/her agreement before the date the amended Terms and Conditions become effective, his/her continued access to or use of the ADWIAH Platform will form acceptance of the amended Terms and Conditions.
We maintain other terms and policies that supplement these terms like our Privacy Policy, which constitutes an integral part of this agreement.
GENERAL TERMS AND CONDITIONS OF USE:
The Platform is available under certain conditions, which the User/Member is deemed, by simply accessing the Platform, to have carefully read and fully accepted.
The User/Member agrees not to use all or part of the Platform for illicit purposes (which include, without limitation, policies violation and standards violation) or for any purpose that are contrary to these Terms and Conditions.
By consulting the Platform, the User/Member agrees to respect these Terms and Conditions as displayed at the date on which the Platform is visited.
PURPOSE OF THE Website, Apps and services:
ADWIAH Platform, this website and/or any of our related applications, do not provide medical advice
The contents of our website, services and/or any related and other material created by us or obtained from any third party (collectively referred to as “Content”) are for informational purposes only. It does not in any way replace a professional medical advice, treatment or prescription.
It is your obligation to always seek the advice of your physician or other qualified health provider for any questions you may have regarding a health or medical condition.
Do not base your decision regarding postponing any professional medical advice due to something you have read on our Website and/or any of our related applications or services.
We do not recommend or endorse any of the protocols, products, or other information mentioned in the Content on the Website, applications or any related services.

ADWIAH PLATFORM RULES:
As a User/Member, you must:
- 1- Do not take any action that could damage or affect the performance of the ADWIAH Platform.
- 2- Do not impair the ADWIAH Platform, do not hack and do not disassemble any of the software any of the ADWIAH ’s software/hardware.
- 3- Only use the “ADWIAH Platform” as authorized by these Terms or another agreement with us.
- 4- Do not use another User/Member’s personal information except as authorized by the applicable laws, regulations and these Terms and Conditions.
- 5- Do not offer on the Platform Services that violate the laws or agreements that apply to you.
- 6- Do not use the name or logo of ADWIAH or others without permission.
Website, App and Services Content:
The Content, on the Website, applications or any related services Is protected by copyright laws.
No page may be copied, reproduced, republished, uploaded, posted, transmitted, framed, commercialized, distributed in any way, or incorporated into any other website or other information system.
However, the legitimate user may download a single copy of the viewed materials on any single computer for personal, non-commercial home use only, provided all copyright and other proprietary notices are kept intact.
Ownership of the Content is exclusive to Adwiah or its licensors, and any use of the content not expressly permitted by Adwiah and those Terms and Conditions is a breach of these Terms and Conditions and automatically terminates your right to use the Content and any related services without prejudice to any and all of the indemnification clauses and conditions as mentioned under the Indemnification paragraph. Furthermore you must destroy any copies or portions of Content in your possession, subject to a penalty payment equal to 1000$ per day of delay.
FEES:
ADWIAH may charge fees and applicable taxes to Members for using the ADWIAH private section of the Platform.
(Our Service Fees page determines when service fees apply and how they are calculated).
ADWIAH has the right to change the service fees at any time and will provide the Users/Members notice of any fee changes before they become effective. Memberships or subscriptions made prior the fee changes will not be affected until they must be renewed. If the User/Member disagrees with the fee change, he may terminate the agreement at any time by sending ADWIAH an email or by deleting his/her account.
REGISTRATION:
Registration is compulsory for this Website, in order to access and use many features of the ADWIAH platform.
Registration is only allowed for legal entities, partnerships and natural persons who are 18 years or older. Each User/Member should warrant that he/she is not a person or entity barred from using the ADWIAH platform under the Lebanese laws or any other applicable jurisdiction.
Each User/Member should submit accurate, current and complete information during registration, and keep his/her account information up to date. The User/Member is responsible for maintaining the confidentiality and security of his/her account credentials. And most importantly, every User/Member is responsible and liable for activities undertook through his/her account and must immediately inform ADWIAH if he/she doubts that his/her credentials have been lost or stolen.
The User/Member may not register more than one account or transfer his/her account to someone else.
The User/Member grants Adwiah and all other persons or entities involved in the operation of the Site the right to transmit, monitor, retrieve, store, and use your information in connection with the operation of the Site. Adwiah cannot and does not assume any responsibility or liability for any information you submit, or for your or third parties’ use or misuse of information transmitted or received using Adwiah tools and services.
TERMINATION:
The agreement between ADWIAH and the User/Member is effective when you simply access the ADWIAH platform (like creating an account) and remains in effect until the User/Member or ADWIAH terminate the agreement in accordance with these terms and conditions.
At any time, the User/Member may terminate this agreement by sending ADWIAH an email or by deleting his account.
ADWIAH may terminate this agreement and the User/Member’s account by giving him a /15/ days notice via email or any other contact information he has provided.
If the User/Member breaches these terms and conditions, violates our policies and/or applicable laws, or if We believe that the termination of this agreement is necessary to protect ADWIAH , its Members or third parties, ADWIAH has the right to terminate this agreement immediately and without prior notice.
If the User/Member’s account has been inactive for more than /2/ (two) years, ADWIAH may terminate his account without prior notice.
USERS/MEMBERS VIOLATIONS:
ADWIAH may, with or without prior notice (i) limit your access to or use of the ADWIAH Platform and your account, (ii) remove, reviews, or other Content, (iii)cancel any status associated with your account if:
1- You breach these Terms and Conditions, our Policies, or our Standards.
2- You violate applicable laws, regulations, or third-party rights.
3- ADWIAH considers it is necessary to protect ADWIAH and its Users/Members.
DISCLAIMER OF WARRANTIES:
ADWIAH provides its Platform without warranty of any kind and disclaims all warranties:
- 1- ADWIAH does not warrant the existence, behavior, performance, safety, quality, exhaustivity, suitability of any Service, Listing or information.
- 2- ADWIAH does not warrant the performance of the ADWIAH Platform.
- 3- ADWIAH does not warrant that verification and identification, conducted on Users/Members, will recognize past misconduct, or prevent future misconduct. A verified Listing or a verified User/Member indicates that the Listing or User/Member has completed a relevant verification process and nothing else.
It is important to mention that, if the User/Member has legal rights or warranties that ADWIAH cannot disclaim, the duration and extent of any such legal rights or warranties will be limited to the maximum range permitted by law.
LIABILITY:
ADWIAH will not be held liable for any accidental, special, consequential damages, lost profits, loss of data or loss of goodwill, service interruption, computer damage, system failure or for any damages for personal or physical injury or death or emotional distress arising out of:
- 1- These terms and conditions.
- 2- The use of or inability to use the ADWIAH Platform.
- 3- The behavior, performance, safety, quality, exhaustivity, suitability of any Service, Listing or information.
- 4- Any communications, interactions you may have with someone you communicate, or interact, with via ADWIAH Platform.
These limitations of liability constitute an essential element of the agreement between ADWIAH and the User/Member.
In any case and under any applicable law, Adwiah, its licensors, its suppliers, or any third parties mentioned on the ADWIAH Platform Site shall be liable only to the extent of actual damages incurred by you, not to exceed a maximum of U.S. $/1000/ It should be noted that, if applicable law does not allow the limitations of liability set out in these terms and conditions, the above limitations may not be applied.
INDEMNIFICATION:
The User/Member agree to release, defend, indemnify and hold ADWIAH harmless from and against any claims, liabilities, damages, losses and expenses arising out of or in connection with:
- (i) Breaching of these Terms and Conditions or ADWIAH policies.
- (ii) The inappropriate use of the ADWIAH Platform.
- (iii) claims regarding any liability, loss, claim and/or expense arising from or related to Your access and use of the Site, apps or related services, including information obtained through the Site, apps or related services.
- (iv) The User/Member’s interaction with any member, participation in an Experience or other Host service, including any injuries, losses or damages of any kind.
- Breaching of any laws, regulations or third-party’s rights.
MISCELLANEOUS PROVISIONS:
These Terms and Conditions constitute the whole agreement between ADWIAH and the User/Member concerning the access or use of the ADWIAH Platform and replace any and all prior understandings or agreements between ADWIAH and the User/Member. Knowing that these Terms and Conditions may be completed by additional Documents that will constitute an integral part of the agreement.
These Terms and Conditions are not meant to grant any rights to anyone other than the User/Member and ADWIAH.
ADWIAH ’s failure to carry out any right or provision in these Terms and Conditions will not form a waiver of such right or provision unless it is agreed by ADWIAH Platform. ADWIAH shall not be responsible for any delay or failure to carry out resulting from causes outside its reasonable control (Force Majeure), including but not limited to natural disasters, terrorism, wars, pandemics, or disease….
In the event that any provision of these Terms and Conditions becomes invalid or unenforceable, the provision in question will be struck and will not affect the validity and the effectiveness of the remaining provisions.
If the Member/User is not satisfied with all or part of the ADWIAH Platform, or if the User/Member does not agree with these Terms and Conditions, their only remedy is to discontinue use of the ADWIAH Platform by deleting their account.
Conditions, as well as any related document, and fully agrees with them.
The User/Member may not assign, transfer or mandate this agreement without ADWIAH ’s prior written approval. But ADWIAH may, without limitation, assign, transfer or mandate this agreement at its sole discretion, with /15/ days prior notice.
MISCELLANEOUS PROVISIONS:
These Terms and Conditions are governed by and interpreted in accordance with the Lebanese laws, especially the law number 81 dated October 18th, 2018 related to electronic transactions and personal data.
Any dispute that may arise from the interpretation or implementation of these Terms and Conditions that cannot be resolved amicably will be submitted to the competent Lebanese Courts.
